    Statutory Management

    On April 4, 2022, the Company encountered financial challenges. This led the insurance industry regulator, the Insurance Regulatory Authority, to appoint a Statutory Manager, The Policyholders Compensation Fund, to take charge of and conduct the affairs of the Company. The mandate of the Statutory Manager was to administer the Company with the view of establishing modalities for reviving the Company by ensuring strict compliance with the Insurance Act. After 21 months of efforts to revive the Company, the Insurance Regulatory Authority moved to court to have the Company placed in liquidation.

    On 21st December 2023, the High Court at Nairobi in Insolvency Cause HCCOMMIP/E077/2023 directed that the Company be placed under interim liquidation pending the determination of the substantive suit. Mr Long’et Terer, MBS was appointed as the Interim Liquidator and is tasked with managing the Company’s affairs and in particular tracing, verifying and securing the company's assets as well as receiving, reviewing and verifying claims from creditors.

What is liquidation?
Liquidation is the process of closing down a business and distributing its assets to pay off debts. This involves selling off company assets to settle claims and other liabilities and eventually winding up the company.
How can I make a claim?
You can file a claim with the Liquidator by following these steps:

  • Download the Claim form (Proof of Debt form) here or pick the form from the Liquidator’s office located at Office No A2, 1st Floor, Wu-Yi Plaza, Galana Road, Kilimani.
  • Complete the form in duplicate and attach supporting documents.
  • Submit the completed form to the Liquidator for verification, approval and payment processing.
  • Submissions will be accepted from 9:00AM to 4:00PM, Monday through Friday, excluding Public Holidays.

Will I get full payment?
Full payment of claims is not guaranteed. The liquidator will prioritize settling debts and claims according to the order of priority outlined in the Insolvency Act, using proceeds from sold assets and recovered debts. How long does the liquidation process take and when shall I be paid? The duration of the liquidation process can vary significantly. It involves collecting and selling assets, as well as pursuing debts, which are time-consuming. Payment will be made once these steps are completed.
Can my claim be rejected?
Yes. If you fail to correctly fill the Proof of Debt form and provide the necessary supporting documents of your claim, the Liquidator may reject your claim.
